Insurance Litigation
Our Insurance Litigation attorneys have
broad experience in the insurance issues that confront most corporations. Traditionally, these involve
coverage disputes and declaratory judgment actions seeking to clarify
coverage. But there is also increased focus on having the correct
coverage with the appropriate endorsements and exclusions, having procedures in place
to notify brokers and insurance companies of claims, and monitoring
the handling and litigation of such claims.
We have experience in insurance litigation of all types
involving coverage questions for clients in a wide variety of industries.
Frequently, these are "high stakes" or "bet the company" exposures. They
may occur in the context of "directors and officers," "errors and
omissions," "environmental," or "comprehensive general liability" policies.
These are often highly complex and require an understanding of technically
written policies, endorsements, exclusions and riders. Questions of
"timely notice" are also frequently arise.
In addition to such litigation experience, our lawyers
have evaluated coverage and policies (in conjunction with the client's
insurance group and its broker) to determine the appropriate coverage for
the identified risks. We also have experience in representing a client's
insurance trust, which is used to cover its self-insured retention. In
connection with insurance trusts, we have been asked to design litigation
reporting systems, attorney accreditation processes and guidelines and
have played an active role in supervising significant claims and
litigation throughout the country.
While we draw on the entire resources of the firm, the
nucleus of our insurance litigation group has substantial business
litigation experience.
