David has a diverse litigation practice, with substantial experience as the lead trial lawyer in various types of civil litigation. David’s practice includes product liability litigation, construction disputes, and the representation of railroads.
David developed a challenge in the trial and appellate courts to mandatory Missouri jury instructions presented in a case he tried to verdict in 2003. That challenge culminated in a victory before the United States Supreme Court in Norfolk Southern Railway Co. v. Sorrell, 127 S.Ct. 799 (2007).
David has served as the first chair trial lawyer in a number of cases tried to verdict. David's trial experience includes cases in state courts in Missouri and Illinois and in federal court. He has handled arbitrations through the AAA and dozens of mediations. He is involved in mass pharmaceutical litigation, including multi-district litigation involving VIOXX®. David has represented contractors, owners, and lenders in construction disputes that have involved prosecuting and defending against damage claims and mechanic's liens. David has handled various matters for railroads, including personal injury cases involving severe injuries and fatalities, grade crossing litigation, and labor issues.
