Kathy Wisniewski has focused her legal career in the field of litigation since graduating from law school more than 20 years ago. She has defended large corporations in all types of consumer claims, personal injury matters, contract disputes, insurance coverage disputes, and a host of other matters. For the past 13 years, she has focused her practice primarily in the area of class actions. She has had numerous successful outcomes for various clients, some of which are detailed below.

Class Action Reports, Inc.: Editorial Board (2005-2008)

Woodruff v. Chrysler Motors LLC, (Case No. 07-4250 W.D.Mo. 2007) (dismissing case in which plaintiff sought certification of a nationwide class, finding that plaintiff's interpretation of warranty contract was not reasonable)

DaimlerChrysler Corporation v. Inman, 252 S.W.3d 299 (Tex. 2008) (holding named plaintiffs lacked standing to pursue claims based on unmanifested seatbelt defect, and dismissing class action)

Allen v. DaimlerChrysler Motors Co. LLC, 2007 WL 2774440 (Cal. App. 2007) (affirming denial of class certification)

White v. DaimlerChrysler Corp., 856 N.E.2d 542 (Ill. App. 2006) (affirming dismissal of class action based on alleged defects in exhaust manifolds due to failure to adequately plead a material omission and damages)

Bardin v. DaimlerChrysler Corp., 136 Cal. App.4 1255 (2006) (affirming dismissal of class action and holding that use of inferior quality components is not “unfair” under California consumer protection laws even if product manufacturer fails to disclose the inferior quality)

Perkins v. DaimlerChrysler Corp., 890 A.2d 997 (N.J.App. 2006) (affirming involuntary dismissal of consumer fraud class action and holding that vehicle manufacturer has no affirmative duty to inform consumers that a product may malfunction after expiration of the warranty period)

Bussian v. DaimlerChrysler Corp., 411 F.Supp.2d 614 (M.D.N.C. 2006) (dismissing implied warranty and consumer fraud claims in class action)

Fiore v. First American Title Ins. Co., 2006 WL 2506460 (S.D.Ill. 2006) (dismissing all claims with prejudice in class action brought to recover up-charges in real estate closing)

Fiore v. First American Title Insurance Co., 2005 WL 2506460 (S.D.Ill. 2005) (denying motion to remand and granting motion to dismiss plaintiff’s claims without prejudice for failing to plead fraud with particularity)

Lee v. Chrysler Corp., 2005 WL 449762 (Ohio App. 2005) (noting denial of class certification by trial court, and upholding trial court’s dismissal of negligence claim and claim for damages under consumer statute)

Speights v. Stewart Title Guaranty Co., 186 S.W.3d 715 (Ark. 2004) (establishing law that Arkansas courts can hear and decide dispositive motions prior to class certification)

Quacchia v. DaimlerChrysler Corp., 122 Cal.App.4t 1442 (Cal.App. 2004) (trial counsel in case wherein class certification was denied, and subsequently affirmed on appeal, for claims based on alleged defects in seatbelt buckles)

Inman v. DaimlerChrysler Corp., 121 S.W.3d 862 (Tex.App. 2003) (reversing certification of nationwide class)

Carson v. DaimlerChrysler Corp., 2003 WL 1618076 (Tenn.App. 2003) (upholding dismissal of class action based on mootness grounds because defendant had offered to provide voluntary relief to class members prior to filing of claims)

Haas v. DaimlerChrysler Corp., 611 N.W.2d 382 (Minn.App. 2000) (affirming dismissal of class action involving warranty transfer fees)

Rosemann v. Roto-Die Co., 947 S.W.2d 507 (Mo.App. 1997) (affirming summary judgment in favor of defendant in shareholder dispute)

Alexander v. DaimlerChrysler Corp., 2004 WL 179369 (N.C.Super. 2004) (granting summary judgment to defendant as to all plaintiffs in case alleging violation of Lemon Law disclosure mandates)
