We represent and counsel clients throughout the United States in virtually all types of corporate recovery, bankruptcy and insolvency matters. In the first U.S. News/Best Lawyers Best Law Firms rankings, released in 2010, our practice achieved National Tier 1 ranking for Bankruptcy and Creditor Debtor Rights/Insolvency and Reorganization. Our practice encompasses counseling and advising secured creditors, unsecured creditors, borrowers, debtors, creditors' committees, equity holders, boards, officers and directors, trustees, examiners, receivers, landlords, lessors and preference defendants in out-of-court restructurings and workouts as well as in federal and state court reorganization, liquidation and litigation proceedings. We also represent purchasers of, and investors in, financially distressed businesses and assets.

We have an experienced insolvency practice group with a national reputation and a proven track record of attaining successful results for our clients. Of the 17 attorneys in our practice, 14 practice exclusively in the area of business bankruptcy and insolvency law. These attorneys have a reputation as tough negotiators and skilled litigators who are highly qualified in all aspects of insolvency practice.

We attribute our success in insolvency matters to the teamwork of our practice area and our interdisciplinary approach to managing cases.   • We currently represent the senior debt syndicate in the bankruptcy of Affiliated Foods Southwest, Inc. and its affiliates in the United States Bankruptcy Court for the Northern District of Arkansas. The debtor is one of the largest wholesale food cooperatives in Arkansas, Louisiana, Mississippi, Texas and Oklahoma.
  • We served as lead bankruptcy counsel to President Casinos, Inc. and its subsidiaries in connection with their Chapter 11 reorganization proceedings, including drafting, negotiating and gaining confirmation of three separate plans of reorganization in which all creditors have been paid in full and equity security holders stand to receive a substantial distribution.
  • We recently advised a purchaser in its successful bid to acquire numerous retail carpet and flooring stores located throughout the United States as part of a plan of reorganization confirmed in the seller's bankruptcy case in Houston, Texas.
  • We recently defended a trade creditor in a preference case in the United States Bankruptcy Court for the Middle District of Tennessee by successfully asserting an issue of first impression – that unpaid shipments of goods qualifying for administrative expense status constitute “new value” for purposes of the creditor’s new value preference defense.
  • We currently represent the Official Committee of Unsecured Creditors in the Chapter 11 bankruptcy of U.S. Fidelis, Inc., once regarded as the nation's No. 1 seller of extended auto service contracts.
