STATE AUTHORIZATION AND LICENSURE

Our attorneys have experience working with state education agencies throughout the country on a wide range of matters. We have helped institutions analyze possible state jurisdiction over cross-border, online or hybrid programming, and subsequently obtain licensure for both on-ground and online locations and programs as required. We regularly counsel institutions on applicable state statutes and regulations and assist in developing various agreements and disclosures in conformance with those laws.

Our attorneys have advised institutions responding to consumer complaints filed with their state education agency or attorney general, or both, and coordinated responses to audits or investigations arising at the state level or across multiple states. In all instances, we work closely with our clients to understand their mission, policies, and objectives, and then craft a responsive strategy that keeps the institution’s priorities at its core.

Finally, as noted in the “U.S. Department of Education” section, we also counsel institutions in matters concerning state student aid programs, state and federal workforce funding, and the various funding programs administered by the U.S. Department of Veteran’s Affairs, U.S. Department of Defense, and the State Approving Agencies.
