  • OVERVIEW
  • PROFESSIONALS
There are more medicines and medical devices on the market today than at any other time and a record number in development. With hundreds of millions of dollars invested in researching and marketing each new drug and device, pharmaceutical companies need sophisticated legal guidance to manage their considerable risks. As drug companies and device manufacturers dedicate themselves to improving the quality of life for all patients, our firm has the practice depth and experience to protect their interests through every stage of that process.

Our representation of pharmaceutical manufacturers goes back more than 70 years, beginning with Pfizer and its predecessor companies. Because of this history, we have comprehensive knowledge of the regulations that affect the industry. In the last decade, pharmaceutical companies have chosen our attorneys to defend them in product liability litigation and class actions relating to vaccines, hormone replacement therapies, weight loss drugs, cancer treatment, rheumatoid arthritis treatment, medical devices, acetaminophen toxicity and in multidistrict VIOXX® litigation. We vigorously defend our pharmaceutical clients because we understand that maintaining the public trust in their medicines is a priority for the industry.

For pharmaceutical companies, safeguarding intellectual property is of paramount importance, and our firm has the capacity to meet their needs in this key area. Our IP attorneys have in-depth experience in the protection and management of intellectual property portfolios and in litigation. Likewise, our international commerce attorneys can assist pharmaceutical clients in working with Customs and Border Protection and the U.S. State Department to protect themselves against unregulated imports and counterfeit medicines entering the marketplace.

Our experience serving pharmaceutical companies extends to mergers and acquisitions, environmental litigation and Environmental Protection Agency (EPA) actions, and labor and employment matters. In addition, we provide advice to clients regarding antitrust issues and assist them in implementing antitrust compliance programs.

  • We have defended Pfizer, Inc., in multiple product liability suits alleging serious personal injury as a result of taking various hormone replacement therapy drugs.
  • We represented a pharmaceutical company in product liability litigation relating to the Thimerosal vaccine. This case was tried in Madison County, Ill., a notoriously plaintiff-friendly venue.
  • We have defended Johnson & Johnson in a putative class action regarding drug counterfeiting.
  • CIMA v. KV Pharmaceutical
We represented the pharmaceutical manufacturer in this patent infringement case involving the composition of prescription drugs. With approximately $30 million at stake, we defended the preliminary injunction hearing which involved extensive Markman interpretation. The court entered a judgment in favor of our client on the motion for preliminary injunction.
  • We successfully challenged an EPA penalty levied against Archimica, Inc., a privately held pharmaceutical fine chemical company with seven manufacturing facilities in Italy, France, Germany, Great Britain and Springfield, Missouri. Our attorney demonstrated to EPA officials that several of the alleged violations were based on EPA's apparent misinterpretations of the applicable regulations. After a review of all the information submitted by Archimica and our arguments, the EPA reduced the penalty to a negligible amount.
