We then identify applicable statutory and regulatory requirements for the retention of data. With these tools in hand, we work with clients to develop standing policies for data preservation, document retention/destruction and e-mail usage policies. We also counsel clients on privacy and security issues.
Because e-discovery obligations arise even before a lawsuit is filed, we work with clients to draft, issue and maintain litigation hold notices, identify custodians and gather documents for review.
