Our experienced insolvency practice group is a team of attorneys with a proven track record of attaining successful results for our clients.

We represent and counsel clients throughout the United States in virtually all types of corporate recovery, bankruptcy and insolvency matters. We counsel and advise lenders of all types, secured and unsecured creditors, borrowers, debtors, creditors' committees, equity holders, boards, officers and directors, trustees, examiners, receivers, landlords, lessors and preference defendants in out-of-court restructurings and workouts as well as in federal and state court reorganization, liquidation and litigation proceedings. We also represent purchasers of, and investors in, financially distressed businesses and assets.

We attribute our success in insolvency matters to the teamwork of our group and our interdisciplinary approach to managing cases. We assist our clients in the largest and most complex of matters, while at the same time retaining the staffing flexibility to handle smaller matters efficiently and cost-effectively. Our flexibility and firmwide resources allow us to service our clients in complex niche industries that unexpectedly experience financial distress. We have significant recent experience in matters involving tax credit enhanced real estate projects, municipal bankruptcies, agriculture, gaming, dealer finance, and transportation. Our ability to quickly develop a depth of knowledge about unique insolvency events demonstrate our group’s dedication to serve clients facing difficult and unique situations.

We represented the senior debt syndicate in the bankruptcy of Affiliated Foods Southwest, Inc. and its affiliates in the United States Bankruptcy Court for the Northern District of Arkansas. The debtor is one of the largest wholesale food cooperatives in Arkansas, Louisiana, Mississippi, Texas and Oklahoma.

We served as lead bankruptcy counsel to President Casinos, Inc. and its subsidiaries in connection with their Chapter 11 reorganization proceedings, including drafting, negotiating and gaining confirmation of three separate plans of reorganization in which all creditors have been paid in full and equity security holders stand to receive a substantial distribution.

We recently advised a purchaser in its successful bid to acquire numerous retail carpet and flooring stores located throughout the United States as part of a plan of reorganization confirmed in the seller's bankruptcy case in Houston, Texas.

We recently represented the Official Committee of Unsecured Creditors in the Chapter 11 bankruptcy of U.S. Fidelis, Inc., once regarded as the nation's No. 1 seller of extended auto service contracts.

We represented a dairy cattle lessor in the Sixth Circuit Court of Appeals where the appellate court reversed the lower courts and held that our client had a true lease and not a security agreement.

We represented the federal court receiver in selling a multi-state chemical analysis and testing company, which was awarded the Turnaround Management Association’s Transaction of the Year.

We obtained a dismissal for a Missouri municipality in litigation surrounding a failed industrial development.

We represented a lender in obtaining confirmation of a creditors’ plan in three jointly administered cases involving 10 different lenders and over 40 different secured loans.
