Properly Extending Credit for Private Education Student Loans


The Higher Education Opportunity Act (HEOA) enacted in 2008 authorized the Higher Education Act (HEA) and established new institution-based loan disclosure requirements.  HEOA also amended the Truth in Lending Act (TILA) and established private education loan disclosures, and amended both HEA and TILA to prohibit certain education lending practices.

  • Will provide a review of the federal and state regulatory frameworks regarding private education loans
  • Will outline the proper process that both higher educational institutions and financial institutions are required to follow before funds are disbursed
  • Will discuss the new student loan servicing licensing acts being enacted or proposed in almost all states.
