ED’s Proposed Borrower Defense to Repayment Rule: A Detailed Examination

On July 6, 2022, the U.S. Department of Education (the “Department”) released its much anticipated proposal for revising its Borrower Defense to Repayment (“BDR”) rule.  We invite you to join us for a special, 2-hour webinar on July 29, 2022, during which we will discuss the rule in detail, highlight significant changes, and suggest opportunities for public comment.  The discussion will be led by Aaron Lacey, the Chair of our Higher Education Practice, and include attorneys Jeff Fink and Hope Watson. In the interim, we invite institutions to download a redline we created that shows the proposed revisions to the current regulation.
