Jasmine Wynton takes on high-stakes business litigation matters, working with clients across many industries in responding to and managing civil disputes. These involve allegations including breach of contract, fraud, negligence, breach of fiduciary duty, and tortious interference with contracts and prospective business relations.
With sophisticated experience and a keen sense for defusing emotional situations, Jasmine helps clients weather government investigations and federal enforcement actions. She guides them through complex investigations and litigation brought by the Department of Justice and the Securities and Exchange Commission involving allegations of consumer, health care, and securities fraud. She also helps corporate clients respond to state and federal False Claims Act qui tam actions.
Jasmine’s experience also includes resolving employment litigation stemming from the complicated nature of employer-employee relationships. She is called upon to handle state and federal anti-discrimination laws and other employment-related statutes.
In 2019, Jasmine was seconded to the Dallas District Attorney’s Office to prosecute criminal cases as an assistant district attorney. Before entering private practice, she served as a law clerk with the U.S. District Court for the Northern District of Texas and the Supreme Court of Texas. Her prior work as a judicial law clerk gives her firsthand, inside experience in federal and state courts, enabling her to help clients present the best case before local judges.

- Obtained dismissal of a breach of contract action against a former officer of a business-to-business financing company.
- Represented a major aeronautics defense contractor in defending claims of fraud and violations of the Federal Acquisition Regulation, resulting in a favorable dismissal of the case.
- Represented health care providers in reimbursement disputes with insurance companies for out-of-network health care claims for emergency services in state and federal court.
- Represented a propane tank exchange company in state court lawsuit brought by a competitor alleging defamation, business disparagement, and tortious interference breach of contract claims, including successfully opposing a request for a temporary restraining order, resulting in a voluntary dismissal of all claims by opposing party.
- Represented two former directors of an oil and gas exploration and production company in state court lawsuit brought by the company for fraudulent transfer and breach of fiduciary duty, resulting in voluntary dismissal of all claims with prejudice by plaintiff.
- Defended online travel companies in nationwide litigation brought by state and local municipalities in federal and state courts, seeking to extend hotel room rental taxes to their internet travel reservations services.
- Represented an online travel company in a first-of-its kind qui tam lawsuit alleging violations of the Delaware False Claims Act for failure to escheat unredeemed gift card balances as un-claimed property, resulting in a favorable dismissal from the lawsuit.
- Represented a reorganized company in a fraud suit against former principals seeking recovery of over $90 million.
Employment
- Successfully dismissed and compelled arbitration of an employment discrimination dispute against a telecommunications provider in the Northern District of Texas and in the Fifth Circuit.
- Obtained summary judgment in an arbitration on behalf of a telecommunications provider, resulting in a dismissal of a former employee’s retaliation claim.
- Won a motion to dismiss in an arbitration for a telecommunications provider, resulting in a dismissal with prejudice of a former employee’s disability discrimination claims.
- Represented a telecommunications provider in arbitrations of employment disputes brought by former employees before the American Arbitration Association.
- Conducted internal workplace investigations and counseled employers on compliance with state and federal anti-discrimination, family and medical leave, and wage-and-hour statutes.
- Represented major aeronautics defense contractor in federal court lawsuits involving age, disability, race, and gender discrimination claims.
- Represented a global business solutions company in defense of EEOC and Texas Workforce Commission charges of age and disability discrimination, resulting in the dismissal of charges.
White Collar Defense and Investigations
- Represented a former officer of a dietary-supplement distribution company in a criminal fraud and misbranding prosecution brought by the Department of Justice. Successfully argued a motion for a downward variance at sentencing hearing, reducing our client’s sentence by one year.
- Defended home health agency in Department of Justice criminal health care fraud investigation.
- Represented an officer of a real estate investment company in parallel Department of Justice and Securities & Exchange Commission investigations involving allegations of violations of federal securities laws.
Pro bono and appointed representation
- Represented amicus curiae in in landmark case in the Fifth Circuit regarding the constitutionality of the State Bar of Texas’s mandatory bar dues.
- Represented a prisoner in 42 U.S.C. § 1983 civil rights lawsuit alleging denial of medical care and use of excessive force in federal district court.
- Successfully represented indigent litigants on appeal in the Texas Supreme Court in an ultra-vires action challenging a county district clerk’s practice of collecting court costs from indigent litigants.
- Represented a Rwandan client in administrative defensive-asylum proceedings.
- Counseled a national nonprofit organization in a commercial real estate dispute.
