As a dedicated and strategic advocate in bankruptcy and commercial litigation, Katie Clark provides counsel on cases involving insolvencies, restructurings, reorganizations, and liquidations, as well as on general business issues arising in an array of industries, including energy and real estate.
Katie brings a highly experienced, innovative approach to representing clients before arbitration panels and bankruptcy, federal, state and appellate courts nationwide. Her familiarity with a broad range of insolvency and corporate legal and operational issues gives Katie a wide-lens perspective and deep insight into each matter she takes on.
Katie’s clients include banks, court-appointed fiduciaries, secured and unsecured creditors, companies, and different capital structure constituencies, as well as debtors (on occasion). She handles Chapter 7, 11, 13 and 15 bankruptcies, troubled business cases, and actions related to fraud resulting in bankruptcy or other displacement of management or control. In addition, Katie guides clients in large insolvency cases where billions of dollars of liability are at stake.
When serving as a state and federal court receiver in bankruptcy and fiduciary representations, Katie combines legal prowess with business acumen to craft practical and just resolutions. She finds it highly gratifying to help those who have been defrauded recover the money they’re due. In addition, Katie often acts as a Subchapter V trustee, reviewing debtors’ financial statements, creating recovery plans acceptable to creditors and making frequent court appearances while carrying out her duties. Always professional and congenial, Katie fosters collaboration amongst diverse parties in order to procure optimal resolutions and preserve business relationships while zealously protecting and advancing her clients’ interests.

- Served as counsel to the court-appointed fiduciary for a life settlement company with more than $1.4 billion in liabilities.
- Represented Ch. 7 Trustee
- Represented an oil and natural gas company and its affiliates, a public company upstream debtor, which obtained confirmation of a pre-negotiated Chapter 11 plan in four months.
- Represented operators and other property owners in the defense of their rights in recharacterization fights in Texas and Delaware bankruptcy courts.
- Represented a debtor, a Mexican glass manufacturer, in a cross-border (Chapter 15) restructuring of more than $2 billion in liabilities.
- Represented a financial institution as a lead creditor in a case that resulted in a successful reorganization of a major development in the Austin, Texas area.
- Represented numerous tenant-in-common (TIC) clients in a matter in the U.S. Bankruptcy Court, District of Delaware, Wilmington Division.
- Represented court-appointed receivers appointed in civil securities fraud actions.
- Represented a client in appeal of an award of fraud and damages for fraud resulting in a reversal of the award.
- Represented a life insurance company in claim for breach of contract and breach of alleged fiduciary duties
