John Galvin Discusses PFAS Liability Trends

In a recent Inside EPA article, Thompson Coburn partner John Galvin was quoted on the evolving landscape of PFAS litigation, particularly concerning downstream users.

John shared his perspective at the American Conference Institute’s “PFAS Regulation, Compliance and Litigation” annual conference on May 30. During his presentation, he said: “Now we’re seeing the second wave of cases come forward, the next wave of cases against companies that did not manufacture PFAS. They didn’t design it, they didn’t create it, they didn’t profit from the sale of PFAS, per se.”

In the emerging second wave of cases against companies that didn’t manufacture PFAS, he said, defendants may be “truly innocent sellers.” He noted such entities being targeted include food manufacturers and packaging companies, cosmetic companies, grocery stores and water suppliers.
