Rob Lang on Defining Fair Market Deals in College Sports

Thompson Coburn partner Rob Lang was recently quoted by The Associated Press regarding the College Sports Commission’s role in determining what constitutes a “fair market deal” for college athletes.

With the rise of name, image, and likeness (NIL) payments, this commission is poised to become the new “police” of college sports. While there will be an appeals and arbitration process, some cases are still expected to end up in court.

“You’re just waiting to see, what is a ‘valid business purpose’ (for an NIL deal), and what are the guidelines around that?” Rob said. “You can see all the lawyer fights coming out of that.”
