In a recent Law360 article on trademark trends to watch for in 2026, Thompson Coburn partner Sartouk Moussavi explored the growing use of anonymity and ex parte orders to pursue groups of online vendors accused of selling counterfeit goods.
Sartouk said the legal strategy has “been abused unquestionably” by parties that assert rights “with basically no notice to the defendants.”
“[Defendants] oftentimes learn about it after an action has already been taken ex parte, which does raise real due process concerns,” he said.
