U.S. DEPARTMENT OF EDUCATION

Our attorneys offer a full range of services designed to assist clients in managing the voluminous and complex requirements of the federal financial aid programs set out in the Higher Education Act of 1965 (HEA) and its implementing regulations. Our services include:

  • Helping institutions prepare for and manage program reviews, audits, and investigations related to federal financial aid programs and conducted by the U.S. Department of Education, guaranty agencies, or external auditors.
  • Advising clients concerning compliance with various technical elements of the federal financial aid programs, including clock-to-credit hour conversion, satisfactory academic progress, attendance, withdrawal, and the Return of Title IV Funds, among others.
  • Counseling clients on compliance with federal reporting and disclosure requirements, including those related to the Clery Act, gainful employment regulations, FERPA, federal graduation and placement rates, and private education loans.
  • Preparing and submitting applications for recertification or approval of substantive changes (e.g., change in location, programming, ownership) through the Department of Education’s Electronic Application system.
  • Conducting internal investigations and mock reviews to help institutions identify, manage, and resolve internal legal and regulatory compliance concerns.
  • Executing the teach-out or closure of an institution or additional location in compliance with applicable federal, state, and accreditor requirements.
  • Obtaining clarification and guidance from the Department of Education, particularly in areas of new or emerging law.

We also counsel institutions in matters concerning state student aid programs, state and federal workforce funding, and the various funding programs administered by the U.S. Department of Veteran’s Affairs and U.S. Department of Defense.
